Victory for California: Ninth Circuit Strikes Down Ammunition Background Check Law
San Diego, CA — The California Gun Rights Foundation (CGF) is celebrating today’s landmark ruling from the U.S. Court of Appeals for the Ninth Circuit, which struck down California’s unconstitutional ammunition background check law.
In a major win for Second Amendment rights, the court found that California’s burdensome system, requiring background checks for every ammunition purchase, violates the Constitution and cannot stand.
“This is a victory not just in the courtroom, but for every peaceable Californian who refuses to accept the idea that their rights must come with a permission slip,” said CGF Executive Director Michael Schwartz. “The right to keep and bear arms means what it says and that includes the ability to keep them operable.”
For years, the State of California has erected barrier after barrier to punish lawful gun owners and discourage the exercise of fundamental rights. Today’s decision is a powerful affirmation that those rights are not negotiable.
“Whether in courtrooms, legislatures, or communities across this state, we are fighting to restore liberty and stop these unconstitutional attacks,” Schwartz said. “Today’s ruling is proof that the tide is turning. The Constitution is winning.”
